The City of Berwyn has enacted an ordinance against prohibited noises emitted from a motor vehicle. The ordinance prohibits any person to make, or cause to be made, loud, unnecessary or unusual noises or noises which annoy, disturb, injure or endanger the comfort, repose, health, peace or safety of others in the City. Actions so prohibited include but are not necessarily limited to any motor vehicle on the public way, if the sound generated by the device in the vehicle is clearly audible to a person with normal hearing at a distance greater than 75 feet. (This does not apply to any person participating in a parade or public assembly for which a permit has been obtained pursuant to city ordinances.)
Any person who violates this ordinance shall be subject to a fine of up to $750. Additionally, the motor vehicle used in this violation will be subject to seizure and impoundment. The owner of record for the vehicle shall be liable to the city for a penalty of $500, in addition to fees for the towing and storage of the vehicle. Violation of this ordinance can result in fines and penalties paid to the City of Berwyn of up to $1,250 plus the fees due to the towing company for the towing of the vehicle and daily storage fees.
